Work site safety can prevent on-the-job injury or death

California readers know that work site safety is imperative for any worker participating in construction or renovation. A recent and tragic work site accident illustrates how job dangers can lead to on-the-job injury or death for workers. In this particular incident, a worker was killed after a dirt wall collapsed on him. 

The construction worker died after being buried alive in a 12-foot trench. The man was working on a large home being built in Milpitas, California, when the incident occurred. Before any construction project can begin, permits much be granted, approving the project. The CEO of the construction company claims that a city inspector visited the job site before the accident occurred yet did not ask the company to cease working on the project. 

The CEO of the construction company was arrested on charges of involuntary manslaughter because of the fatal accident. The arrest implies that the CEO may have instructed or allowed workers on job sites that were not permitted or safe. Further details regarding the CEO's role in the accident are not immediately clear. If evidence indicates that either the CEO or the city inspector were negligent, the family of the deceased may file a civil claim against the liable party. 

Generally, a worker can receive workers' compensation for an on-the-job injury, just as the family may receive the compensation in the case of a death. However, in cases of gross negligence demonstrated by the employer or other extreme circumstances, victims or families may consider taking additional legal action. The family of the deceased worker may also wish to seek wrongful death restitution for the unexpected expenses and emotional trauma associated with this unexpected and fatal accident.
