What are a victim's rights after a construction accident?

A major construction accident can leave California victims with extensive physical injuries, emotional trauma and mounting medical bills. Even experienced construction workers can be injured or killed because of unsafe site conditions and/or failure to be properly trained. No matter what caused a construction accident, injured workers or the families of those killed may consider filing a workers' compensation claim.

On construction sites, some of the most common reasons for accidents relate to what is known at the "Fatal Four." The Fatal Four includes falls, electrocution, being crushed in between two objects and being hit by an object. Twenty percent of all on-the-job deaths in 2013 were in the construction industry. It has been estimated that eliminating the risk for any of the Fatal Four from construction sites could save hundreds of lives per year.

There are many hazards on a construction site, but one of the most effective ways to prevent accidents is to properly train all workers to recognize, avoid and eliminate unnecessary hazards. Providing safety equipment and enforcing safety measures can save lives and prevent injuries. In the event that an accident does occur, California workers or remaining family members may seek financial support through the workers' compensation system.

Filing a claim after a construction accident can be a complex process, made more difficult by the emotional difficulties of the situation. When a victim or family has the guidance and counsel of a legal professional experienced in workers' compensation law, it can make the process smoother and help in making beneficial decisions. After a work accident of any kind, it is preferable to seek a complete case evaluation before moving forward.
