Worker dies from fatal work injury after falling from a truck

A California worker has died after falling out of a truck while working in San Jose. The fatal work injury was sustained during a fall from a boom truck as he was working retrofitting lights along the street. The cause of death is not immediately known, but an autopsy will be performed by a Santa Clara County medical examiner.

It is not clear how far the deceased employee, who worked for ABM Electrical & Lighting Solutions, fell, but the Occupational Safety and Health Administration (OSHA) is conducting an investigation. This is normal procedure after a work injury or fatality in California. The investigation may be related to a lack of safety training, improper restraint equipment or another preventable factor.

When a fatality occurs at work, a family suddenly finds themselves facing immense grief and a major financial burden at the same time. When a main wage earners dies, a family will face the impact of lost wages, as well as medical bills and funeral costs. The family of the worker who fell off the truck and died may seek death benefits through the employer's workers' compensation insurance in order to recover their financial losses.

Successfully filing a claim for rightful benefits after the death of a family member can be a complicated process. The workers' compensation system is governed by rules that are constantly changing, and many applications for benefits are initially denied. This is why it is important to have the assistance of a lawyer who understands the system and will work diligently to secure deserved benefits after a fatal work injury.
