Workers' compensation death benefits for fatal accident

The California city of Berkeley has been fined $100,000 after a fatal accident claimed the life of a worker after he was crushed by a garbage truck. The worker, one part of a two-person team, was collecting garbage when the truck began roll. The truck brakes failed, and the man was unable to move out of the way as he was trying to stop the truck. Due to the circumstances of this work accident, the family may be able to collect workers' compensation death benefits.

According to reports, the man was still conscious and talking to emergency responders on the scene after the truck pinned him against a tree. He was taken to a hospital, but he succumbed to his injuries later that day. The deceased was a dedicated employee of the city of Berkeley and had been employed by the city for 25 years. 

This accident launched an Occupational Safety and Health Administration investigation into the city operations, which found several safety concerns and regulation violations. The city was ultimately fined $100,000 for failing to properly train employees on safe braking and other ways to prevent safety hazards. It is thought that three specific penalties and violations were the direct cause of the man's unfortunate death.
