When workplace injuries are fatal, families have rights

| Jan 9, 2016 | Workplace Injuries |

A work accident can have consequences that affect a worker and his or her family for months or years to come. Recovery can be complicated and workplace injuries may mean that a person cannot return to the same job as before the accident. However difficult some work accidents can be, it is just as difficult, if not more, for families of workers who sustained fatal injuries.

A fatal work accident will certainly have a financial impact on a grieving family. From medical care, emergency treatment, lifesaving measures and funeral costs, a family may be surprised to learn that the death of their loved one can lead to financial ruin. Fortunately, California families have certain rights in these situations, including the right to seek financial compensation for their losses.

Those left behind may be eligible to claim death benefits through workers’ compensation. Dependants can recover funeral costs, a certain percentage of the income of the deceased and possibly other losses. Qualifying for these benefits is contingent on the circumstances of the work accident and requires verifiable documentation that proves the death was caused or hastened by the incident.

The workers’ compensation process in California is complex, and it can be hard to know how to properly file a claim and seek rightful benefits. Our team can protect the rights of grieving families by helping them navigate the legal process and seek death benefits to which they are rightfully entitled. After a work accident, or when workplace injuries result in death, we can evaluate the situation, identify possible legal remedies and tenaciously pursue the best outcome on behalf of the families.
