A California man employed as a tree trimmer fell approximately 60 feet to his death while at work in Magalia. At the time of the fall, the man was performing a task called topping, which is where a worker trims just the top of the trees. He was fatally injured on the job when the base of the tree broke while he was working.
The owner of the tree company stated that the employees attend regular weekly training meetings. It is not clear if the fall could have been prevented or if the man was equipped with the proper safety gear, but his family has a claim to workers’ compensation benefits to cover their financial losses. His employer has stated that all workers have been trained to work safely, follow OSHA safety measures and react properly in adverse conditions.
At this point, authorities from Cal/OSHA are investigating the accident. No matter what the cause of the fatal accident may be, family members of the deceased have certain rights that should be protected. Workers’ compensation insurance benefits could be granted to cover funeral costs, lost wages and other financial losses.
When a loved one is killed or a California worker is injured on the job, a lawyer experienced in workers’ compensation claim can ensure that the necessary steps are taken for a rightful recovery. Obtaining benefits may not be easy, but a lawyer can help when a claim has been denied or delayed. The workers’ compensation system can be complex, but there is no need to navigate it alone.
