Steps to take to receive compensation after being injured at work

People in California have many different types of jobs. There are different physical requirements at different jobs, some use heavy machinery, others are in an office setting, some require driving various vehicles and many other requirements. No matter what type of job people have though, they generally are able to go to their job and come home safely afterwards.

However, some jobs have more inherent dangers than others and accidents occur. These accidents can lead to significant injuries, which not only require medical treatment, but also force the victim to miss work and lose income. This can put these people in a very difficult situation both physically and financially. People who are injured at work may be entitled to workers’ compensation benefits though, which can at least ease the financial burdens.

In order to receive these benefits though, people need to follow the appropriate steps.

  1. First the injured worker needs to inform their employer of the injury and get an emergency medical care they need to treat the injuries.
  2. Next injured workers need to get a Workers’ Compensation Claim Form and provide it to the employer.
  3. After filling out the form and returning it, people need to continue to seek medical treatment from their doctor. This is important because the treating doctor’s reports will be used to determine the extent of the injuries and when people will be able to return to work. The doctor’s reports will also be used to determine if the worker can do a different type of work while recovering. So, receiving good medical care from professionals who understand the extent of the injury is important.
  4. After the Workers’ Compensation Claim Form is returned, the employer must submit it to their claims administrator who will determine if the claim is accepted or denied. If it is accepted, the worker will begin receiving workers’ compensation benefits. If it is denied, people do have a right to challenge the decision.
