In order to be eligible for benefits, an injury must occur at the workplace while doing your job. In other words, “within the course and scope” of your employment. Insurance companies will fight hard to show you do not meet this standard, so be aware that your claim may be initially denied.

What Are The Benefits For California Work Injuries?

Injured workers can claim workers’ compensation benefits in California for the four following basic benefits:

  • Temporary disability benefits: You may be entitled to receive two-thirds of your gross pay until you are declared to medically able to return after a work injury. Temporary benefits will cease after two years from the date of the injury.
  • Permanent disability benefits: These benefits are determined by a doctor’s analysis of what percentage of your work potential you have permanently lost due to a work-related injury. Compensation will be in relation to this number.
  • Medical treatment: Medical treatment of a work-related injury is automatically covered by workers’ compensation, and unless your claim is denied outright this will be covered.
  • Rehabilitation: This essentially provides a permanently disabled worker with a voucher, scaled to his or her level of disability, which will allow him or her to enter a retraining program in order to learn new skills.
